The Supreme Court issued a reasoned judgment, available to Advokatskaya Gazeta, in case No. 5-KG21-107-K2, drawing courts’ attention to the need to examine circumstances carefully in disputes over a child’s residence. In particular, it stated that courts must involve a competent authority to assess the child’s living conditions in another country. The defendant’s advocate told the newspaper that the Supreme Court had shown objectivity, impartiality and wisdom because it put the child’s interests first. One expert noted that the lower courts had resolved the dispute without fully examining legally significant circumstances. Another believes the ruling is important for developing equality between men and women in raising children.
