DEBTORS WILL NOT BE LEFT WITHOUT FUNDS

Income equal to the subsistence minimum may not be debited from debtors. All you need to do is apply to the Federal Bailiff Service, including online, or to your bank. Read our explanation, which includes links to the relevant laws.

1) PRESERVE THE SUBSISTENCE MINIMUM.

At the debtor’s request, monthly income of at least the subsistence minimum for a working-age person will be retained in one bank account. The nationwide figure in 2023 is 15,669 rubles. Alternatively, the subsistence minimum in the Russian region where the debtor lives for the relevant socio-demographic group applies if that amount is higher.

2) CAN YOU KEEP EVEN MORE?

If a debtor supports a relative with a disability or other dependants, they may apply to the court to retain funds exceeding the statutory subsistence minimum.

3) WHERE TO APPLY?

You can apply in person to the Federal Bailiff Service unit handling the proceedings, or online through Gosuslugi under ‘Submitting Applications and Motions to the FSSP’.

You can also contact the bank. This helps if the enforcement document was sent directly to a credit institution without bailiffs.

4) EXCEPTIONS.

The law provides exceptions where this rule does not apply:

— recovery of child support;

— compensation for injury to health and harm resulting from the death of a breadwinner;

— compensation for damage caused by a crime.

5) PAYMENTS FROM WHICH BAILIFFS CANNOT RECOVER DEBT AT ALL.

— one-off and all other social payments introduced by acts of the President and government;

Payments under a social contract.

— compensation for injury to health;

Survivor’s pension.

— child support;

Maternity capital.

— payments for caring for people unable to work;

— monthly monetary payments, such as compensation for travel and medicine purchases;

Benefits for citizens with children.

— several one-off financial assistance payments.
